Terms of Service

These Terms of Service ("Terms") govern your use of the SocietyCart customer app and the SocietyCart Shop app (the "Service"). SocietyCart is a brand owned and operated by MYCLOUDWISH TECHNOLOGIES PRIVATE LIMITED, a company incorporated in India ("MYCLOUDWISH", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Acceptance of Terms

By creating an account or placing an order through SocietyCart, you confirm that you have read, understood, and accepted these Terms, as well as our Privacy Policy. These Terms form an agreement between you and MYCLOUDWISH TECHNOLOGIES PRIVATE LIMITED. We may update these Terms from time to time. Continued use of the Service after changes are posted means you accept the updated Terms.

Eligibility and Accounts

You must be at least 18 years old to create an account and place orders.

Accounts are created using an Indian mobile number verified by a one-time password (OTP). You do not need a password. Each mobile number may only be associated with one active account. You are responsible for keeping your device and access secure. If your device is lost or stolen, contact us immediately.

You may browse the Service without an account, but you must sign in to place orders, save favourites, or use certain features.

The SocietyCart Marketplace

SocietyCart is a marketplace and ordering platform. Independent shops located inside your residential society list their products on SocietyCart. When you place an order, you are buying directly from that shop — the shop is the seller, and SocietyCart operates the platform that connects you.

Product availability, pricing, and delivery times are set by each shop. Shops are responsible for preparing and delivering the products you order. SocietyCart is not liable for incorrect prices, out-of-stock items, substitutions, or product quality, though we will help resolve disputes where we can.

Ordering and Cancellation

Orders can be placed for immediate delivery or scheduled up to 2 days ahead, within a shop's operating hours. When you place an order, you are making an offer to purchase the listed items at the stated price. The shop accepts your order when they mark it as confirmed.

You may cancel an order before the shop confirms it. Once the shop begins preparing your order, cancellation may not be possible. Refunds for cancelled orders are issued to the original payment method or your SocietyCart reward wallet, depending on the payment method used.

Pricing and Payment

Prices are set by each shop and displayed in Indian Rupees (₹), inclusive of applicable taxes. Delivery fees, if any, are shown before you confirm your order. Prices may change at any time, but orders already placed are honoured at the price shown when the order was confirmed.

Payment can be made by cash on delivery (COD), UPI on delivery, or online via card, UPI, wallet, or netbanking through our payment processor, Razorpay. SocietyCart does not collect or store your card details — all payment information is handled securely by Razorpay.

You agree to pay the full order amount, including any delivery fees or taxes. If payment fails or is disputed, we may suspend or cancel your order and restrict your account.

Delivery

Delivery is available only within the residential society where the shop is located. You must provide a valid delivery address (society, tower, and flat) at checkout.

Delivery times displayed are estimates provided by the shop. We aim to deliver as quickly as possible, but delays may occur due to order volume, preparation time, or other factors. SocietyCart is not liable for late deliveries.

You or someone you authorise must be available to receive the order at the delivery address. If delivery cannot be completed due to an incorrect address, unavailability, or refusal to accept the order, you may still be charged.

Rewards, Coupons and Referrals

SocietyCart may offer loyalty rewards, coupons, and a referral program. Rewards are earned on successfully delivered orders and can be redeemed at checkout. Coupons may have specific terms, expiry dates, and usage limits.

Rewards and coupons have no cash value, are non-transferable, and cannot be exchanged or refunded. We reserve the right to modify, suspend, or discontinue any reward, coupon, or referral program at any time, and to withdraw or expire unused rewards or coupons.

Misuse of rewards, coupons, or referral codes — including creating multiple accounts, fraudulent referrals, or exploiting system errors — may result in forfeiture of rewards and account suspension or termination.

User Content (Reviews and Ratings)

You may rate and review products and shops after an order is delivered. Reviews must be your own honest experience. By submitting a review, you grant SocietyCart a non-exclusive, worldwide, royalty-free licence to use, display, and share your review.

You agree not to post content that is unlawful, abusive, threatening, defamatory, obscene, misleading, or infringes on anyone's rights. Reviews must relate to your actual purchase — reviews placed without a verified purchase may be removed.

We reserve the right to remove, hide, or refuse to display any review or rating that violates these Terms or is reported as inappropriate. If you believe a review violates these Terms, you can report it by emailing info@societycart.in or using the Help & Support option in the app.

Acceptable Use

You agree to use the Service only for lawful purposes and in a way that does not harm SocietyCart, other users, or the shops. You agree not to:

• Use the Service to commit fraud, place fake orders, or engage in any unlawful activity.
• Interfere with or disrupt the Service, servers, or networks.
• Attempt to gain unauthorised access to any part of the Service or other users' accounts.
• Use automated tools (bots, scrapers, etc.) to access the Service without permission.
• Harass, threaten, or abuse shop staff, delivery personnel, or SocietyCart support.

Violation of these rules may result in immediate suspension or termination of your account.

Intellectual Property

All content on the Service — including text, graphics, logos, images, software, and design — is owned by SocietyCart or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our prior written permission.

Shop names, product images, and descriptions are provided by the shops and remain their property or the property of their licensors.

Account Deletion and Termination

You may delete your account at any time from Profile → Delete account in the app, or by contacting us. Deletion is immediate and cannot be undone. Full details of what is removed are on the Delete Account page.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Service. If we terminate your account, any outstanding rewards or balances are forfeited and you may be barred from creating a new account.

Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without any warranties, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that product listings, prices, or availability are always accurate or up to date.

SocietyCart is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill, even if we were advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid for the specific order or transaction giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, legal requirements, or business practices. When we do, we will post the updated Terms here with a new "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of India.
